1. Overtime Eligibility


In Malaysia, employees earning up to RM4,000 per month are eligible for overtime pay. 

However, specific categories of employees, such as managerial or executive positions, may be exempt from overtime pay entitlements. The following employees are typically eligible for overtime compensation under the 2022 amendment:

  • Earning RM 4,000 and below per month.
  • Engaged in manual labour, regardless of wages.
  • Individuals operating or maintaining mechanized vehicles, irrespective of wages.
  • Supervising or overseeing manual labourers, regardless of wages.

2. Maximum Overtime Hours


To protect employees' well-being, the Employment Act limits the number of overtime hours an employee can work. The maximum allowable overtime hours are:

  • 104 hours per month
  • 24 hours per week

Employers cannot compel employees to work beyond these limits without prior approval from the Director-General of Labor.

How to Calculate Overtime Pay?


Overtime pay is calculated based on the employee's ordinary rate of pay and the number of overtime hours worked. The ordinary rate of pay is the employee's basic salary divided by the normal working hours per month.

Formula for Overtime Compensation Rate Calculation


When calculating overtime pay, we should start from ORP and HRP:

  • ORP (Ordinary Rate of Pay) = Monthly Rate of Pay ÷ 26 ÷ 8
  • HRP (Hourly Rate of Pay) = ORP ÷ 8

OT compensation rate differs from normal working days, rest days and public holidays. Here’s details:

Normal Working Days HRP × 1.5
Rest Days Under half of normal working hours ORP × 0.5
More than half of normal working hours but not exceeded normal working hours ORP × 1.0
More than normal working hours HRP × 2.0
Public Holidays Under normal working hours ORP × 2.0
